Terms of Service

These Terms of Service govern your access to and use of the Clouteye platform. By signing up, you confirm you have read and agree to these terms in full.
1. Acceptance of terms
By accessing or using Clouteye ("the platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the platform. We may update these terms at any time; continued use after changes constitutes acceptance.
2. Description of service
Clouteye provides real-time social listening and keyword tracking tools for TikTok, Instagram, and Threads. We aggregate publicly available data, detect trend spikes, and surface analytics for African brands and creators. The platform is provided on a subscription basis with a 7-day free trial.
3. Account registration
To use Clouteye you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access at support@clouteye.com.
4. Subscriptions and billing
Paid plans are billed on a monthly or annual basis as selected at checkout. Your subscription renews automatically unless cancelled before the renewal date. We do not offer refunds for partial billing periods. Free trial periods do not require a credit card; you will only be charged if you choose to upgrade to a paid plan.
5. Acceptable use
You agree to use Clouteye only for lawful purposes. You must not: (a) attempt to reverse-engineer, scrape, or extract our underlying data infrastructure; (b) resell or redistribute platform data without written permission; (c) use the platform to harass, stalk, or harm any individual; (d) attempt to circumvent any security or access controls; or (e) violate any applicable Nigerian or international law.
6. Intellectual property
All platform software, UI design, branding, and proprietary data models are owned by Clouteye and protected by applicable intellectual property laws. You retain ownership of any content you provide to the platform. By using the platform, you grant us a limited licence to use your content solely to provide the service.
7. Third-party data and platforms
Clouteye aggregates publicly available data from third-party social platforms. We are not affiliated with TikTok, Instagram, or Threads. The availability and accuracy of data depends on those platforms' APIs and may change without notice. We do not guarantee uninterrupted data coverage.
8. Disclaimer of warranties
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or that data will be complete or accurate at all times. We disclaim all implied warranties including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, Clouteye shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the three months preceding the claim.
10. Termination
We may suspend or terminate your account at any time if you breach these terms or if we believe your use poses a risk to other users or the platform. You may cancel your account at any time from your account settings. Upon termination, your access to the platform will cease and your data will be deleted per our Privacy Policy.
11. Governing law
These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
